Terms of Service

1. Agreement to Terms

By accessing or using the services of Prestige Waves Yachting ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and Prestige Waves Yachting.

2. Eligibility

To use our services, you must:

• Be at least 21 years of age (25 for certain exotic vehicles)
• Possess a valid driver's license (for vehicle rentals)
• Have a valid credit card in your name
• Meet our insurance and background check requirements
• Provide accurate and complete information during booking

3. Services

Prestige Waves Yachting provides luxury rental services including yacht charters, exotic car rentals, party bus services, and limousine transportation in the Miami, Florida area. All services are subject to availability and may be modified or discontinued at our discretion.

4. Reservations and Payments

Deposits: A non-refundable deposit of 50% is required to secure your reservation. The remaining balance is due 7 days prior to your rental date.

Security Deposit: A security deposit ranging from $2,500 to $25,000 (depending on the rental type) is required and will be authorized on your credit card prior to rental.

Payment Methods: We accept major credit cards (Visa, Mastercard, American Express) and wire transfers. Cash payments are not accepted.

5. Cancellation Policy

• 30+ days before rental: Full refund minus $500 processing fee
• 14-29 days before rental: 50% refund of total amount
• 7-13 days before rental: 25% refund of total amount
• Less than 7 days: No refund
• Weather-related cancellations (yachts): Full credit toward future booking or reschedule

6. Use of Rental Property

You agree to:

• Use rental property only for lawful purposes
• Not exceed passenger capacity limits
• Not operate vehicles while impaired by alcohol or drugs
• Not smoke in any rental vehicle or vessel
• Not transport illegal substances or contraband
• Follow all maritime laws and regulations (for yacht charters)
• Return property in the same condition as received

7. Insurance and Liability

Basic liability insurance is included with all rentals. You are responsible for any damage, loss, or theft not covered by insurance, including deductibles. We strongly recommend purchasing additional coverage.

You agree to indemnify and hold harmless Prestige Waves Yachting from any claims, damages, or expenses arising from your use of our services.

8. Damage and Loss

You are responsible for reporting any damage or incidents immediately. Failure to report damage may result in additional charges. Damage assessments will be conducted upon return of rental property, and applicable charges will be applied to your security deposit or credit card on file.

9. Geographic Restrictions

Vehicle rentals are restricted to Miami-Dade, Broward, and Palm Beach counties unless otherwise agreed in writing. Yacht charters are limited to designated Florida waters. Violation of geographic restrictions will result in immediate termination of rental and forfeiture of deposit.

10. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Prestige Waves Yachting and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our written permission.

11. Limitation of Liability

To the maximum extent permitted by law, Prestige Waves Yachting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid for the specific rental giving rise to the claim.

12. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

14. Modifications

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any modified terms.
